These laws are found in California Civil Code Section 3333.4 and their purpose is to restrict the damages an injured accident victim can receive if he or she was hurt while driving without insurance. An uninsured accident victim can get his or her medical bills paid. The victim can also be compensated for time missed from work due to injuries sustained as a result of the other driver’s negligence. However, because the victim did not have the required liability insurance, by law, he or she is not entitled to receive payment from the at-fault driver’s insurance company for non-economic damages, like pain and suffering.
